It shall be unlawful to design, develop, or make available an artificial intelligence chatbot knowing or with reckless disregard that the chatbot encourages, promotes, or coerces suicide, self-injury, or imminent physical or sexual violence. Any person who violates this provision shall be fined not more than $100,000 per offense. A covered entity, as defined in the act, shall require each individual accessing a chatbot to make a user account in order to use the chatbot. For any chatbot that exists as of August 28, 2026, a covered entity shall freeze the account, require the user to provide age data to restore the account, and using the age data classify each user as a minor or an adult. At the time an individual creates a new user account to interact with a chatbot, a covered entity shall request age data from the individual, verify the individual's age using a reasonable age verification process, and classify each user as a minor or an adult using the age data. A covered entity shall periodically review previously verified user accounts using a reasonable age verification process. A covered entity may contract with a third party to employ reasonable age verification measures as part of the age verification process, as described in the act. A covered entity shall establish reasonable measures to protect personal data as described in the act. Each artificial intelligence chatbot shall at the start of each conversation with a user at 30-minute intervals disclose to the user that the chatbot is artificial intelligence and not a human being and be programmed to ensure that the chatbot does not claim to be a human being. The chatbot shall not represent that the chatbot is a licensed professional, as described in the act, or that the chatbot provides certain professional services, as described in the act. If the age verification process determines that an individual is a minor, a covered entity shall prohibit the minor from accessing any chatbot made available by the covered entity. Under the act, a minor shall be considered engaged in the work of content creation under certain criteria, as described in the act, at any time during the previous twelve-month period. A minor who is thirteen years of age or older may produce, create, and publish his or her own content and shall be entitled to all compensation from such content. Any content creator whose content features a minor engaged in content creation shall maintain certain records, as described in the act, and shall retain such records until the minor reaches the age of twenty-one. The content creator shall provide notice to the minor of the existence of such records. A minor who is engaged in the work of content creation shall be compensated by the content creator. The content creator shall set aside gross earnings, as described in the act, on any content including but not limited, the likeness or name of the minor in a trust account to be preserved for the benefit of the minor upon the minor reaching eighteen years of age. Requirements of the trust account are described in the act. After August 28, 2026, any individual who was featured in a content creator's post on a social media platform as a minor may request that the content creator delete or edit the post to remove any content involving the minor. The content creator shall delete or edit the post if the information provided by the individual is uniquely identifiable. Social media platforms shall provide an easily accessible mechanism through which the individual can submit a request for the removal of the content featuring the minor. Social media platforms shall notify the content creator within a reasonable time period, but no longer than thirty days, after receiving a removal request. The content creator shall delete or edit the post from the social media platform within 72 hours after receiving notice from the social media platform. If the content creator fails to delete or edit the post involving the minor within the specified time period, the social media platform shall take all reasonable steps to remove or edit the content involving the minor subject to certain exceptions as described in the act. It shall be unlawful to financially benefit from intentionally or knowingly producing or distributing on social media any visual depiction of a minor with the intent to sexually gratify or elicit a sexual response, or any other restricted material involving a minor, subject to the exceptions described in the act. A social media platform shall develop and implement a strategy to help mitigate risks related to monetization of restricted material involving minors. Requirements of such strategy are described in the act. Any individual may report violations of the act to the Attorney General. If the Attorney General finds that provisions of the act have been violated, the Attorney General shall bring a civil action. Remedies are described in the act. Nothing in the act shall preclude an individual from bringing a private civil action for any violations of the act. A commercial entity or a third party that performs age verification shall not retain any identifying information of the individual.
A commercial entity that is required to perform age verification under the act shall post certain notices on its website, as described in the act.
The act shall not apply to bona fide news or public interest broadcasts or other media and shall not affect the rights of a news-gathering organization.
An internet service provider or subsidiary, search engine, or cloud service shall not be held liable for violating provisions of the act solely for providing internet access to any content not under the provider's control.
The Attorney General shall enforce provisions of the act. If the Attorney General believes that a violation occurred and an action is in the public interest, the Attorney General may commence an action. If the court finds that a violation occurred, the court may grant relief, as described in the act.
The act is identical to SB 1346 (2026), SB 1412 (2026), and similar to HCS/HBs 1839, 2921 & 3015 (2026).
