Questions

Are self-driving cars legal?

It depends on the state. Where a state has legislated, it sets the rules: who may operate a fully autonomous vehicle, whether a human driver must be on board, insurance and crash reporting, and how a traffic violation by a driverless vehicle is handled. In 2025 and 2026, California, Mississippi, Montana, Tennessee, Utah and Virginia enacted autonomous vehicle laws, listed above with what each requires.

Is there a federal autonomous vehicle law?

Congress has not passed one. Vehicle design falls under the federal motor vehicle safety standards set by NHTSA, and operation on the road is left to the states. 4 autonomous vehicle bills in Congress are on this page.

Which states have the most autonomous vehicle bills?

Missouri (7), New Jersey (7), Illinois (6), California (5) and Massachusetts (5). In all, 85 bills in 31 jurisdictions, the latest action on 30 September 2026. Laws enacted before 2025 are not listed here.

Is this legal advice?

No. Which bills count as autonomous vehicle bills, and the line on what each law requires, are drafted by software and not reviewed by an attorney. Every bill links to the legislature’s own record: read the text before relying on it. The list covers bills from the 2025 and 2026 sessions.
