Questions
Are deepfakes illegal?
It depends on what the deepfake is used for and where. State laws target uses: sexual images of a real person made or shared without consent, sexual images of minors, deceptive media in election communications, and using someone’s voice or likeness without permission. In 2025 and 2026 alone, 27 states enacted 53 laws on these uses, listed above with what each requires.
What states have deepfake laws?
States that enacted deepfake laws in 2025 and 2026: Louisiana (7), Texas (6), California (4), Montana (4), Arkansas (3), Utah (3), Maryland (2), New York (2), Rhode Island (2), Tennessee (2), Virginia (2), Colorado (1), Connecticut (1), Hawaii (1), Idaho (1), Illinois (1), Kansas (1), Michigan (1), New Hampshire (1), New Jersey (1), North Dakota (1), Oklahoma (1), Pennsylvania (1), South Dakota (1), Vermont (1), Washington (1) and Wyoming (1). Laws enacted before 2025 are not listed here.
Is there a federal deepfake law?
Yes, for intimate images. The TAKE IT DOWN Act, signed on 19 May 2025, makes knowingly publishing non-consensual intimate images, including computer-generated ones, a federal crime, and since 19 May 2026 it has required platforms to remove a reported image within 48 hours. 19 other deepfake bills are on this page for Congress.
Which states regulate deepfakes in elections?
States that enacted election deepfake laws in 2025 and 2026: California, Louisiana, Maryland, Montana, North Dakota, Rhode Island, South Dakota, Tennessee and Vermont. They require a disclosure on AI-generated political advertising, or prohibit deceptive synthetic media of a candidate. Laws enacted before 2025 are not listed here.
Is this legal advice?
No. Which bills count as deepfake bills, and the line on what each law requires, are drafted by software and not reviewed by an attorney. Every bill links to the legislature’s own record: read the text before relying on it. The list covers bills from the 2025 and 2026 sessions.
